Terms of Use

These Terms of Use ("Terms") govern your use of Couch Questions ("the App"). By downloading or using the App, you agree to these Terms.

1. Description of Service

Couch Questions is a social party game that generates question and dare cards for group play. The App offers both on-device and cloud-based AI card generation, text-to-speech reading, and multiplayer support across Apple devices.

2. Acceptable Use

You agree to use the App only for its intended purpose as a social party game. You may not:

• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use the cloud AI card generation service to generate content that is illegal, hateful, or intended to harass.
• Attempt to circumvent rate limits or abuse the card generation service.
• Use the App or its services for any commercial purpose without our written consent.

3. AI-Generated Content

Cards generated by the AI features (both on-device and cloud) are produced algorithmically and may occasionally produce unexpected or inappropriate content. We do not guarantee the suitability of AI-generated cards for all audiences. You are responsible for reviewing generated cards and choosing appropriate vibe settings for your group.

4. Subscriptions

The App may offer optional subscription plans that unlock additional features such as cloud AI card generation.

• Subscriptions are billed through your Apple ID account via the App Store.
• Payment is charged at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your device's Settings > Apple ID > Subscriptions.
• No refunds are provided for partial subscription periods. Refund requests should be directed to Apple.

Pricing may vary by region and is subject to change. Any price changes will take effect at the start of your next subscription period.

5. Intellectual Property

The App, including its design, code, built-in card content, and branding, is the property of the developer and protected by intellectual property laws. AI-generated cards created through the App are provided for your personal, non-commercial use.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of data, goodwill, or other intangible losses.

8. Third-Party Services

The App relies on Apple's App Store for distribution and payments, and on Supabase for cloud API infrastructure. Your use of these services is governed by their respective terms. We are not responsible for the availability or performance of third-party services.

9. Age Requirement

There is no minimum age requirement to use the App. However, certain card content may be intended for adult audiences depending on the vibe setting chosen. Parents and guardians should review the vibe settings to ensure appropriateness.

10. Termination

We reserve the right to restrict access to the cloud AI service for any user who violates these Terms. You may stop using the App at any time by deleting it from your device.

11. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the Netherlands.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted at this URL with an updated date. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
